Cura, Inc. (“Company,” “our,” “we”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This Privacy Policy is part of our Terms of Use available here.

In this Privacy Policy we describe the types of information we may collect from you or that you may provide when you use the Cura website and/or mobile application (collectively, the “Platform”), including any content, functionality, and services offered on or through the Platform, and our practices for collecting, using, protecting, and disclosing that information. This Privacy Policy does not apply to information collected by any third party, including through any application or content that may link to or be accessible from or on the Platform.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it, as you agree to this Privacy Policy by using the Platform and/or creating an account on the Platform. If you do not agree with our policies and practices, do not use the Platform.

1. Information We Collect And How We Collect It

We collect several types of information from and about users of the Platform, including:

  • Information needed to create a unique Platform account through which individual users can use the Platform, such as name, email address, and other information you voluntarily add to your Platform profile;
  • Information, data, and materials submitted to the Platform as you use and interact with the content and services offered on the Platform, such as information entered into chats with coaches, background information submitted in a resume through the Platform, and reflection posts, which may include personal information if you voluntarily enter it into the Platform;
  • Billing information used to pay for the Platform if you choose to access the Platform through a paid subscription, such as credit card information, address, and billing contact information;
  • Information that is ascertained through our use of third-party applications, including but not limited to user behavior and trends;
  • Information voluntarily provided by users, emails, or other communications to the Company for support purposes; and/or
  • Information about your internet connection, the device or equipment you use to access the Platform, and Platform usage details.

We collect this information in two ways, including:

  • Directly from you when you provide it to us, such as signing up for an account or submitting information or other materials to use and interact with the content and services offered on the Platform; and
  • Automatically as you navigate through and use the Platform, such as usage details, IP addresses, web browser preferences, and information collected through cookies and other tracking technologies. Although we do not correlate tracking information to individuals, some information collected, such as IP addresses, will be unique.

In some countries, including countries in the EEA, the information referenced above in this Privacy Policy may be considered personal information under applicable data protection laws. If you do not want us to collect this information, do not use the Platform.

2. How We Use Your Information

We use the information that we collect about you or that you provide to us, including any personal information:

  • To provide the Platform and its content and services to you, such as creating an account and profile for you and processing the information or materials you submit to the Platform;
  • To provide information to coaches, professors, school administrators, and other individuals or organizations with whom you are working or associated with in relation to your use of the Platform;
  • To develop, modify, and improve the Platform;
  • For external and internal marketing purposes, provided that such use does not directly or indirectly identify you or your other personal information;
  • To provide you with information, products, or services that you request from us, including to respond to user inquiries or technological issues or problems;
  • To provide you with notices about your account and/or subscription, including billing, expiration, and renewal notices, when applicable,
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • To notify you about changes to the Platform or any services or content we offer or provide through it; and/or
  • In any other way we may describe when you provide the information.

All the data we collect on the Platform is necessary for the Company to deliver the Platform to you and other users. The amount of data we collect has been minimized wherever possible to respect your privacy.

You can withdraw your consent at any time by discontinuing use of the Platform or contacting us at support@cura.com to delete your account and information. However, if you are receiving access to the Platform through a course or other organization that is paying for your account, we may need the consent of the organization paying for your account before fully deleting your account (though we will delete your personal information at any time upon your request).

3. Sharing and Disclosure of Your Information

We may create aggregated, de-identified or anonymized data from the personal data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for any lawful business purposes, including, without limitation, to analyze, build, and improve the Platform and promote our business, provided that we will not share such data in a manner that could identify you.

Additionally, we may disclose information that we collect or you provide:

  • To coaches, professors, school administrators, and other individuals or organizations with whom you are working or associated with in relation to your use of the Platform;
  • To contractors, service providers, employees, and other third parties we use to support, manage, and operate our business, including, without limitation, payment processors, analytics providers, support and customer service vendors, and hosting providers;
  • To our subsidiaries and affiliates;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by the Company about the Platform users is among the assets transferred.
  • To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email another user” feature of the Platform, we will transmit the contents of that email and your email address to the recipients;
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our users, or others; and
  • For any other purpose disclosed by us when you provide the information.

4. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Platform and visiting your account. You may also send us an email at support@cura.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

5. Tracking Tools; Do Not Track Signals

The Platform uses cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve the Platform. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access the Platform. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). Please note that because of our use of Cookies, the Platform does not support “Do Not Track” requests sent from a browser at this time.

We use the following types of Cookies:

  • Essential Cookies. Essential Cookies are required for providing you with features or services that you have requested. For example, certain Cookies enable you to log into secure areas of the Platform. Disabling these Cookies may make certain features and services unavailable.
  • Functional Cookies. Functional Cookies are used to record your choices and settings regarding the Platform, maintain your preferences over time and recognize you when you return to the Platform. These Cookies help us to personalize our content for you, greet you by name and remember your preferences (for example, your choice of language or region).
  • Performance/Analytical Cookies. Performance/Analytical Cookies allow us to understand how visitors use the Platform by collecting information such as the number of visitors to the Platform, what pages visitors view on the Platform, and how long visitors are viewing pages on the Platform. Performance/Analytical Cookies also help us measure the performance of our advertising campaigns in order to help us improve our campaigns and the Platform’s content for those who engage with our advertising.

You can decide whether or not to accept Cookies through your internet browser’s settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways. You can also delete all Cookies that are already on your device. If you do this, however, you may have to manually adjust some preferences every time you visit our website and some of the Services and functionalities may not work.

By using the Platform, you consent to the Company’s usage of cookies and third-party analysis and tracking services on the Platform, such as Google Analytics, and agree that the Company may collect your usage data under a unique identifier, for the purposes of tracking, analyzing, and improving the Platform. If you have questions about how we use these services or the third-party analysis and tracking services we are using at any given time, or wish to withdraw your above consent, please email us at support@cura.com.

6. Children Under the Age of 13

The Platform is not intended for children under 13 years of age and you are not allowed to use the Platform or provide information on it if you are under 13 years of age. If we learn we have received personal information from or about a child under 13 without verification of parental consent, we will delete that information immediately. If you believe we might have any information from or about a child under 13, please contact us immediately at support@cura.com.

7. Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of the Platform that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not disclose your personal information for this purpose, but to make such a request, please send an email to support@cura.com.

8. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access. For example, user information is encrypted through the Platform with Secure Socket Layer technology (SSL) and is also encrypted when it is stored by the Company to prevent unauthorized parties from viewing such information. Also, we perform regular malware scanning of the Platform. All Company employees are required to adhere to our security and confidentiality procedures.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

9. Third Party Links

The Platform may contain links that lead to other websites, and the Company is not responsible for the privacy practices, content, and/or activities of these linked websites. Nonetheless, we seek to protect the integrity of the Platform and welcome any feedback about these external websites.

10. Changes to Our Privacy Policy

We will post any changes we make to our Privacy Policy on this page and you will be notified of any material changes to our Privacy Policy in an email to the most recent email address that you provided to us, if any.
